This website, anthealejardin.com, is owned and operated by Anthea Botanical Home LLC, doing business as Anthea Le Jardin. When we say "Anthea," "we," "us," or "our," we mean Anthea Botanical Home LLC. When we say "you," we mean anyone who visits the site, browses it, creates an account, or buys from us.

Everything on this site — the products, the information, the tools, and the services — is offered to you on the condition that you accept the terms below. Please read them before you use the site. If you don't agree with them, please don't use the site or purchase from us.

Our online store runs on the Shopify platform, which provides the technology that lets us present our products and process your orders.

1. Agreeing to These Terms

By visiting the site or placing an order, you are entering into an agreement with us and accepting these Terms of Service, along with any other policies we reference here, including our Privacy Policy and Returns Policy. This applies to every visitor, whether you are browsing, shopping, or contributing content.

To use this site you must be at least 18 years old or the age of majority where you live. If you are a parent or guardian allowing a minor to use the site, you are responsible for their use of it.

Any new features, tools, or services we add to the site in the future will also fall under these terms.

2. Our Products

We take care to photograph and describe our products accurately, and to show colors as faithfully as we can. Even so, screens vary, and we cannot promise that what you see on your device will match the item exactly. Natural materials such as gemstones, wood, and botanicals also vary from piece to piece, and small differences from the photographs are part of their character rather than a defect.

Some products are available only online, and quantities may be limited. We may change product descriptions, discontinue any product, or limit the quantities we sell to any person or region, at our discretion and without advance notice. Any offer we make is void where prohibited by law.

3. Pricing

Prices are listed in U.S. dollars unless otherwise stated. Our prices in the Rosemary Beach boutique match the prices on this site; however, all prices may change at any time without notice.

When we show a "regular" or "original" price alongside a sale price, that regular price is the price at which the item was offered on this site or in our boutique. It does not guarantee that the item was actually sold at that price, so any savings shown are based on the offering price rather than on past sales.

We try to keep pricing accurate, but errors happen. If an item is listed at an incorrect price or with an incorrect description, we reserve the right to correct the error and to cancel or refuse any order placed at the incorrect price, even after the order has been confirmed. If your payment has already been processed, we will refund it in full.

4. Placing an Order

When you place an order, you agree to provide accurate, current, and complete purchase and account information, and to keep it updated so we can complete your order and reach you if needed. This includes your email address, shipping address, and payment details.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized use of a payment method, or an error in pricing or product information. We may also limit the quantities purchased per person, per household, or per order. If we cancel or change an order, we will try to contact you using the email address or phone number you provided.

Submitting an order is an offer to purchase; the order is accepted when we ship it. Receiving an order confirmation email does not by itself mean the order has been accepted.

5. Shipping and Delivery

We ship to addresses in the United States and Canada. Shipping is not free; shipping charges are calculated and displayed at checkout before you complete your purchase, and they vary by destination, order size, and the shipping method you choose.

If you are located outside the United States and Canada, we are not able to accept your order through the site. You are welcome to send a purchasing request through our contact page at anthealejardin.com/pages/contact, and we will let you know whether and how we can help.

Orders shipped to Canada may be subject to import duties, taxes, and customs fees. These charges are set by Canadian authorities, are not included in our prices or shipping charges, and are your responsibility as the recipient.

Delivery estimates are estimates, not guarantees. We are not responsible for delays caused by carriers, weather, customs processing, or other events beyond our control. Once an order is handed to the carrier, we will provide tracking information where available.

6. Returns and Exchanges

We want you to love what you buy. If you don't, you may return your purchase for a refund or exchange it within 30 days of the delivery date. To be eligible, the product must be returned in its original packaging, together with all packaging materials, in the condition it was received. Custom orders, custom sizing, sale items, and gift cards are not eligible.

To start a return or exchange, contact us first at service@anthealejardin.com. Once your request is approved, we will send you a prepaid return shipping label; for requests made within 30 days of delivery, return shipping is at our expense. Refunds are issued to the original payment method, less a 3% restocking fee. Items not returned in their original packaging, or that show signs of wear, damage, or alteration, may be refused.

7. Information on This Site

The content on this site is provided for general information. While we work to keep it accurate and current, we cannot guarantee that everything is complete, accurate, or up to date at any given moment, and you should not rely on it as the sole basis for any decision without confirming it through other sources. Any reliance you place on the material here is at your own risk.

Some content may be historical and is provided for reference only. We may change the content of the site at any time, but we are under no obligation to update it, and it is your responsibility to check for changes.

8. Errors and Corrections

From time to time the site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery times, or availability. We reserve the right to correct any such error, to change or update information, and to cancel any affected order, at any time and without prior notice, including after you have submitted an order.

We are not obligated to update, amend, or clarify any information on the site except as required by law. The presence of an update date on any page should not be taken to mean that all information on the site has been reviewed or refreshed.

9. Your Ideas, Reviews, and Submissions

If you send us a review, a suggestion, a design idea, a photograph, a contest entry, or any other material — whether we asked for it or not, and whether by the site, email, mail, or otherwise — you agree that we may use it in any way, in any medium, without restriction and without compensation. We may edit, copy, publish, distribute, translate, and otherwise use what you send. We are not obligated to keep it confidential, to pay you for it, or to respond to it.

You promise that anything you submit is yours to give, does not infringe anyone else's rights, and is not unlawful, abusive, defamatory, obscene, or harmful. You will not submit anything containing viruses or malicious code, use a false email address, or impersonate another person. You are responsible for what you submit, and we take no responsibility for content posted by you or by any third party.

We may, but are not required to, monitor, edit, or remove submissions that we consider objectionable or that violate these terms or anyone's intellectual property rights.

10. Your Privacy

The personal information you share with us is handled according to our Privacy Policy, which you can read at anthealejardin.com/policies/privacy-policy. By using the site you agree to the practices described there.

Please be aware that ordinary content you transmit to us — not including payment card details — may travel unencrypted across various networks and may be adapted to meet the technical requirements of those networks. Payment card information is always encrypted in transit.

11. Third-Party Tools and Links

The site may give you access to tools provided by third parties, and it may contain links to websites we don't own or control. We provide access to these tools and links as a convenience only. We do not monitor them, we make no warranties about them, and we do not endorse them.

Third-party tools are provided "as is" and "as available." Any use you make of them is at your own risk, and you should review the third party's own terms before using them. We are not responsible for the content, accuracy, products, or services of any third-party website, and we are not liable for any harm or loss arising from your dealings with a third party. Questions or complaints about a third party's products should be directed to that third party.

Everything on this site — including product designs, photographs, text, graphics, logos, and the arrangement of the site itself — belongs to Anthea Botanical Home LLC or to those who have licensed it to us, and is protected by copyright, trademark, and other laws. You may not reproduce, copy, sell, resell, or exploit any part of the site or its content, or any access to it, without our express written permission.

13. What You May Not Do

In addition to the other restrictions in these terms, you may not use the site or its content to do any of the following: break any law or encourage others to; infringe our intellectual property or anyone else's; harass, threaten, defame, or discriminate against anyone; submit false or misleading information; upload viruses or any other malicious code; collect or track other people's personal information; spam, phish, scrape, crawl, or use automated tools to access the site; pursue any obscene or immoral purpose; or interfere with or bypass the security features of the site or any connected network.

Any breach of these terms may result in immediate termination of your access to the site and our services.

14. No Warranties

We do not promise that the site will be uninterrupted, timely, secure, or free of errors, or that the results of using it will be accurate or reliable. We may take the site offline or discontinue it, in whole or in part, at any time without notice.

Your use of the site, and of the products and services we provide through it, is at your own risk. Except where we expressly say otherwise — including the 30-day return and exchange guarantee described above — the site and all products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, durability, title, or non-infringement.

Our products do not carry a lifetime guarantee or any other warranty beyond what is expressly stated in these terms or at the time of purchase.

15. Limitation of Liability

To the fullest extent permitted by law, Anthea Botanical Home LLC and its members, managers, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for any injury, loss, claim, or damages of any kind — direct, indirect, incidental, special, consequential, or punitive — including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the site, from any product purchased through it, or from any content made available through it, whether the claim is based in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. If that applies to you, our liability is limited to the fullest extent the law permits.

16. Your Responsibility to Us

You agree to indemnify, defend, and hold harmless Anthea Botanical Home LLC and its members, managers, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors from any claim or demand, including reasonable attorneys' fees, brought by a third party as a result of your breach of these terms or the policies they incorporate, or your violation of any law or of the rights of a third party.

17. Ending This Agreement

These terms remain in effect until ended by you or by us. You may end them at any time by telling us you no longer wish to use the site or simply by no longer using it. We may end them, and deny you access to the site, at any time and without notice if we believe you have failed to comply with any part of these terms. Any obligations or amounts you owe as of the termination date survive termination.

18. Governing Law and Disputes

These terms, and any purchase you make from us, are governed by the laws of the State of Florida and applicable federal law of the United States, without regard to conflict-of-law principles. We are located in Walton County, Florida.

Any dispute arising out of or relating to these terms, the site, or any purchase from us will be brought exclusively in the state or federal courts located in Walton County, Florida, and you consent to the personal jurisdiction of those courts and waive any objection to venue there.

Your use of the site may also be subject to the laws of the place where you access it. By using the site, you confirm that doing so is lawful where you are and that you are responsible for complying with your local laws.

19. If Part of These Terms Is Unenforceable

If any provision of these terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent the law allows, and the remainder will be treated as severed from these terms. The validity and enforceability of the remaining provisions will not be affected.

20. The Complete Agreement

These terms, together with the policies we post on the site, make up the entire agreement between you and us about your use of the site and your purchases from us. They replace any earlier agreements, communications, or proposals, whether written or oral, including any earlier version of these terms.

Our failure to enforce any provision of these terms is not a waiver of our right to enforce it later. The section headings are for convenience only and do not affect the meaning of the terms. Any ambiguity will not be interpreted against the party that drafted it.

21. Changes to These Terms

We may update, change, or replace any part of these terms at our discretion by posting the revised version on this page. It is your responsibility to check this page from time to time. If you continue to use the site or make purchases after changes are posted, you are accepting the revised terms. The current version is always available here.
